News10NBC is learning more about a train accident overnight that killed a Schenectady man. 

Police say 41-year-old Troy Zabawczuk tried to jump onto a train as it was pulling away. He was found laying on the tracks and later died at the hospital.

News10NBC talked to several witnesses and police believe Zabawczuk was in an intoxicated condition. He was rather disruptive and belligerent to other passengers on the train.

The Rochester Police Department says just after midnight they were called to the Central Avenue Amtrak station. Employees had found a man laying on the tracks with a head injury and cuts on his body. That man was Zabawczuk. He was later pronounced dead at Strong. Zabawczuk was on the train heading to Chicago, but when the train stopped in Rochester, he got off.

Officer Stephen Scott, Rochester Police Department said, “He left the train on his own volition and when he tried to get back on the train, he was asked not to re-board because of his condition.”

Witnesses say Zabawczuk was drunk. They told police as the train was pulling away they saw him try and jump on the train. Police say he was actually dragged by the train.

Officer Scott said, “His body was found about 90 yards west of the platform. We have all indications it looks like he appeared to jump from the platform to the train. How far he was dragged we don't know.”

News10NBC learned the conductor called employees at the station to let them know there was a passenger not allowed back on board, but police say Zabawczuk wasn’t their responsibility to look after.

Officer Scott said, “He was asked not to come back on board and once he’s off the train, he is responsible for himself.”

News10NBC spoke with a spokesman from Amtrak. They said they are investigating this and don’t have any comment. News10NBC asked them who is responsible to watch the track when a train pulls out and the spokesperson said engineers on board are responsible.
